The Class Licence can be downloaded from the website of the Office of the TelecommunicationsAuthority (“OFTA”) at http://www.ofta.gov.hk. An in-building telecommunications system (“IBTS”) is defined in Schedule 1 to the Class Licence as a telecommunications system installed, established, operated and maintained within the common parts1 of a building or buildings within the development so long as the telecommunications system does not cross unleased Government land or public streets. The IBTS includes telecommunications equipment, cables, blockwiring systems, in-building coaxial cable distribution system (“IBCCDS”) and relevant facilities in, over or upon any common parts of a building for the conveyance of telecommunications and broadcasting services to the residents and occupiers of the building. The common parts include the Telecommunications and Broadcasting Equipment (“TBE”) Room, Secondary Telecommunications and Broadcasting Equipment (“STBE”) Room, telecommunications closets, rooftops, risers, ducts, conduits, etc. Schedule 2 to the Class Licence defines the class of persons who are qualified as licensees (the “Class Licensee”). In brief, the Class Licensees shall be all those persons (whether they are sole owners, joint tenants or tenants in common) who are vested with the legal estate or equitable interest in the common parts of a building or buildings within a development in which the IBTS is installed, established, operated and maintained. The Class Licensee is allowed to install, establish, maintain and operate the IBTS in the concerned building or buildings and is required to interconnect the IBTS, on a non-discriminatory basis, with public telecommunications networks and services licensed, or deemed to be licensed, or exempted from licensing under the Ordinance. The Class Licensee shall use all reasonable endeavours to ensure that interconnection is done promptly, efficiently and at fair and reasonable charges. This Code of Practice is issued pursuant to Condition 4 of the Class Licence and provides guidance to the Class Licensee which may need to share the use of the common parts of the buildings with the local fixed telecommunications network services licensees or fixed carrier licensees (collectively called the “Network Operators”) for the provision of telecommunications and/or broadcasting services to 1 “common parts” of a building is defined in section 1 of the Class Licence. ii the buildings. This Code of Practice sets out the requirements of consultation and coordination between the Class Licensees and Network Operators for the planning, installation and maintenance of their IBTS. The TA may revise or amend in part or in whole of this Code of Practice from time to time. iii 1 General Requirements 1.1 In addition to the requirements as stated in this Code of Practice, the Class Licensee should observe and, as far as possible, comply with the latest editions of the following standards, regulations and codes of practice: (a) IEC65 - Safety requirements for mains operated electronic and related apparatus for household and similar general use; (b) Telecommunications (Control of Interference) Regulations (Cap. 106 sub. leg.B) - Hong Kong; (c) Telecommunications Ordinance (Cap. 106)- Laws of Hong Kong; (d) Relevant Customer Technical Guides or equivalents of the Network Operators; (e) Electricity (Wiring) Regulations issued by Electrical and Mechanical Services Department; and (f) All related regulations, rules and codes of practice of government departments and public utilities, including but not limited to the following: i. Buildings Department ii. Electrical and Mechanical Services Department iii. Fire Services Department iv. Labour Department v. Lands Department vi. Office of the TelecommunicationsAuthority vii. Trade and Industry Department viii. Highways Department ix. Planning Department 1.2 According to Condition 8 of the Class Licence, the use of frequency channels within the IBCCDS is subject to the TA’s approval. For planning purpose, Class Licensee may plan ahead the IBCCDS based on the allocated frequency channels as shown in the relevant HKTA specifications which can be downloaded from OFTA’s website www.ofta.gov.hk. For the implementation of the IBCCDS and the use of the frequency channels, the Class Licensee should submit to OFTA for approval the frequency channel within the IBCCDS for each individual building prior to the launch of the service. 1 ... - tailieumienphi.vn
